A local court in Ahmedabad denied anticipatory bail to a Muslim man who is facing allegations of triple talaq and domestic violence. The judge refused him protection and expressed the opinion that custodial interrogation is necessary.
Mohammed Shoeb Qureshi, a resident of Khamasa, sought anticipatory bail after his wife filed an FIR with Gaekwad Haveli police station on January 30 against him and his family members, accusing them of domestic violence, assault and verbal abuse. She also alleged that her husband pronounced talaq thrice to her in the presence of neighbours She said she was driven out of the matrimonial home.
Police booked Qureshi, his parents and sister, under Sections 498A, 232, 294A and 114 of the IPC and invoked the Muslim Women (Protection of Rights on Marriage) Act, 2019, which was enacted by Parliament after the Supreme Court declared the practice of instant triple talaq unconstitutional and void.
Additional sessions judge HA Trivedi rejected Qureshi’s anticipatory bail plea with the observation that the court did not find it proper to use its discretionary powers in the favour of the accused.
