The Gujarat High Court denied any relief to a law student whose result was cancelled by the Kutch University because she had written some words on the back of the question paper, violating university rules, in a decision related to examination in educational institutes.
The girl student had challenged the university’s decision to cancel the result of one subject, Paper No. CC -105 (special contract), during an exam in July 2021. She was doing Bachelor of Law in Tolani Institute of law, Adipur, affiliated with the university.
The LLB Semester-1 exam took place in July 2021 in which she admittedly happened to write some words on the back of the question paper. When the checking squad discovered her writing on the question paper, they issued her a show-cause notice and conducted an investigation. On September 15, 2021, an order was issued to cancel her result.
The student challenged the order in high court and stated that instructions given to candidates did not prohibit writing on question paper. The university lawyer said that Clause (6) of instructions reads; “Nothing should be written in the marks column or on the question paper.”
