Khyati Hospital Scam: Patients Move Gujarat HC For Separate FIR

Fifteen patients who survived cardiac procedures at the Ahmedabad-based Khyati Multispeciality Hospital in November 2024 have now approached the Gujarat High Court, seeking the registration of a separate FIR and an independent investigation.

Following the deaths of two patients after they underwent unnecessary angioplasty at the hospital, three FIRs were filed—two by the families of the deceased and one by a doctor from a government-appointed panel. The two deceased patients were part of a group of 19 individuals from Borisana village in Mehsana district.

The 15 surviving patients have filed a petition asking the High Court to direct the police to register an FIR, claiming they too are victims of the Pradhan Mantri-Jan Arogya Yojana (PM-JAY) scam as they were allegedly subjected to unnecessary procedures. They stated that they have experienced difficulties following the surgeries and that an investigation is necessary.

The petition highlights that a whistleblower filed the three FIRs, but this should not prevent other victims from seeking the registration of an FIR based on their own complaints.
The lawyer representing the patients, Siddharth Desai, noted that the petition is expected to be heard by the High Court on Thursday.

Meanwhile, Kartik Patel, director of Khyati Hospital, who has been evading arrest since the PM-JAY scam emerged, has filed a petition in the Gujarat High Court, requesting that the three FIRs be clubbed together.
His petition argues that the three FIRs are based on the same set of facts and that conducting three separate investigations and prosecutions would be unnecessary. According to Patel’s lawyer, the petition is expected to be heard soon.

Khyati Hospital has been accused of exploiting government healthcare schemes by performing unwarranted medical procedures on healthy individuals.
The accused were charged under the BNS Act with culpable homicide, attempted culpable homicide, forgery, fraud and criminal conspiracy.
