Gujarat has a bad history of fakes and impersonation. A BJP candidate has come under scrutiny for allegedly contesting a municipal seat as fake Hindu and submitting false documentation. The Ahmedabad Sessions Court has ordered a formal complaint and legal proceedings against BJP councillor Nirav Jagdish Kavi, who is accused of posing as a Hindu with a falsified date of birth during the 2021 Ahmedabad Municipal Corporation elections.
Kavi, who filed his candidacy for the Navrangpura ward on February 5, 2021, listed his birth date as November 11, 1977. However, investigations suggest his actual birth date is June 1, 1975. Furthermore, it is alleged that his real identity is Raj Kavi Mir, who is Muslim, rather than Hindu as he declared.
The Congress party, at a recent press conference, highlighted these discrepancies, claiming that Kavi’s documents, including his Aadhar card, election ID and PAN card, were all created using a false birth date to obscure his true identity and background. Congress candidate for Navrangpura, Jaykumar Patel, had initially reported the matter to local police stations, but after no action was taken, he proceeded with a criminal case (No. 2721/2021) in the Ahmedabad Metropolitan Court. The charges, filed under several sections of the Indian Penal Code (IPC), including sections 191 (false evidence), 192 (fabricating evidence), 193 (false evidence in judicial proceedings), 196 (using evidence known to be false), 199 (false statements made in declaration), 414 (assisting in concealment of stolen property) and 420 (cheating), underscore the gravity of the allegations.
To prove that Kavi’s true birth date is June 1, 1975, court proceedings included testimonies alongside general register records from Pankaj Vidyalaya and Samarth High School. These documents reportedly confirm the June 1975 birth date, contradicting Kavi’s submission of November 1977.
Initially, the Ahmedabad Metropolitan Court dismissed the complaint under Section 203 of the Criminal Procedure Code. However, following an appeal, Sessions Judge M.P. Purohit overturned the lower court’s decision, ordering a formal complaint and the initiation of proceedings against Councillor Kavi under the stated IPC sections.
