A Mirzapur Commercial Court has ruled in favour of Adani Enterprises Limited and SB Adani Family Trust, barring local company PV Adani Juggler Hawk Industries Pvt. Ltd. from using the Adani trademark in its products and services.
The Adani group had alleged that the company’s use of the name ‘Adani’ for its products of biodiesel, natural gas, LPG, lubricating oil, and solar panels, was in violation of trademark rules. The PV Adani Juggler Hawk Industries Pvt. Ltd. was established in 2019. However, Adani Group claims to have been using the trademark since 1999 and 2000.
In 2020, the court temporarily banned PV Adani Juggler Hawk Industries Pvt. Ltd, which was established in 2019, from using the Adani trademark for any Internet-based platform.
The two companies entered into an agreement following an interim judgement by the court. PV Adani Juggler Hawk Industries Pvt. Ltd had assured the multinational company that it would not use its products and trademarks. The court recorded the statement and ruled in favour of the multinational company in respect of the trademark suit.
The court in its ruling has ordered Juggler Hawk to not use its the products and services under the the trademark ‘Adani’ and/or any such brand or tradename with suffix or prefix, which is identical and/or deceptively similar to the plaintiff’s registered trademark ‘Adani’.
