Gujarati singer, Kinjal Dave has won a copyright case in the Ahmedabad City Civil Court over the Gujarati song “Char Char Bangdi Vali Gadi”. Advocates Pratik Chaudhary and Jatin Trivedi, representing Dave, informed the media that the case was filed by Red Ribbon Entertainment Pvt. Ltd., a company claiming to hold the copyright to the song.
The company had purchased the copyright rights to the song from a certain Kartik Patel and sought to prevent Dave or any other person from singing the song, or any company or individual from uploading it on a digital platform, without their permission. However, they were unable to substantiate their claimed rights to the song in court. As a result, the court dismissed the copyright case filed against Dave, along with costs.
The case may not be over yet. Red Ribbon Entertainment Pvt. Ltd. still has the option to appeal the decision in the High Court. If the company does not file an appeal within 15 days, Dave will be free to sing the song on the 16th day. If an appeal is filed, the case will proceed in the High Court.
Dave had previously been accused of copying the song and had sung it despite a court order not to. She had also apologized in court. However, the court did not accept her apology and imposed a fine of 1 lakh rupees, which Dave had to pay. Despite this setback, the recent ruling in the civil court marks a victory for Kinjal Dave.
