A Mehsana court in Gujarat sentenced a man to a 2 years in jail for torturing his wife in a 17-year-long marriage and then divorcing her by saying triple talaq.
The court, invoking the new law of 2019 brought by the Centre against the widely prevelant practice of triple talaq in Muslim community, imposed the jail term and also fined the man Rs 5,000. Notably, in 2019, the first instance of triple talaq was reported in Mehsana Division Police Station.
Fakir Zakirshah Husenshah, residing in Sopan Society in Nagalpur area of Mehsana, got married in 2003 but remarried on January 29, 2018, abandoning his first wife, sending her back to live with her parents.
The situation escalated when Zakirshah physically assaulted his first wife, prompting her brother’s intervention. At that time, Zakirshah threatened and uttered triple talaq. In response, his first wife filed a complaint against Zakirshah under The Muslim Women Act, 2019 at Mehsana Division Police Station.
In Mehsana Sessions Court, Judge SL Mehta sentenced Fakir Zakirshah to two years in prison and fined him Rs 5,000 after arguments by public prosecutor Dhavalbhai Trivedi. This marks the first judgment on a triple talaq complaint in Mehsana district.
