Though in the four years the court took to declare a professor and his doctor-wife from Gandhinagar divorced, they reconciled and decided to give their marriage another shot. It took the couple eight years – double the time to get the divorce – to erase the decree from the records.
The couple got married in May 2006 and had a son in 2009. As their relationship soured, the husband sought judicial separation and filed a divorce petition in a Gandhinagar court in 2011. In March 2015, the family court in Gandhinagar granted them a divorce decree.
However, the wife soon challenged the decree in the Gujarat high court, seeking annulment of the divorce and reinstatement of their marital status.
Instead of challenging it, the husband also joined the case and supported the wife’s demand. The HC stayed the divorce decree the very day the appeal was filed.
The appeal remained pending for years, and it came up for hearing early this February. In their joint affidavit, the couple submitted they were living together and that all the disputes between them had been settled amicably.
While remarrying was an option, the couple insisted they did not want the judgment and decree of divorce to be on paper.
The bench of Justice AJ Desai and Justice RM Sareen quashed the divorce decree and asked the couple to withdraw litigations filed against each other in lower courts in 10 days.
