Deserted By Amdavadi Husband, Tajik Woman Seeks HC’s Help For Visa Extension

In a bid to secure their future, a 35-year-old Tajik woman, married to an Indian Hindu man has approached the Gujarat HC for an extension of their visa after her husband allegedly deserted his marital responsibilities for another woman. The court, presiding over the matter Monday, has sought the Central government’s response by January 31. 

The petitioner traced back the meeting with her estranged husband to 2008 in Tajikstan. They got married later that year in India, according to Hindu rituals. The couple together have a 13-year-old daughter and an eight-year-old son. “However, matters went downhill since 2013 when her husband took to drinking and womanising. There have been several complaints lodged by the woman reporting domestic violence. Finally, the man deserted his family,” shared the Tajik woman’s lawyer. 

Now, caught between a marriage gone wrong and visa for herself and her daughter expiring (her son was born in India), the aggrieved approached the Bureau of Immigration on Dec 14, 2022. However, the Foreigners Regional Registration Office (FRRO) is yet to revert. Meanwhile, the immigration authorities have asked her to leave the country. 

After explaining that they are dependent on their husband for the stay in India, the woman submitted that if the visas are not extended, their lives will be displaced and the children’s education is bound to suffer. 

Justice Biren Vaishnav has directed the FRRO to expedite the decision for visa extension, while also directing an input from the Central government in the matter.
