Gujarat HC Summons 3 Developers, AUDA For Alleged Encroachment Of Land

Gujarat High Court has issued summons to Ahmedabad Urban Development Authority (AUDA) as well as three well-known builders of the state – Swayam Developers, Satvik Developers and Shilp Developers – in connection to petitions filed by a senior citizen. In three separate petitions, the person has alleged that the three builders obtained the possession letter and notarized the signature of his sibling and encroached on some parts of his land.

Later on, the three developers submitted an application to AUDA to develop the said land, he said. However, the petitioner said that the notarization is dated August 28, 2019, and that the said sibling was not even in the country at the time. The three developers have also obtained photographs of the sibling for the application.

Petitioner Ramesh Patel has said that he and his siblings have jointly owned the agricultural land in Kalol in the Gandhinagar district for decades. Some of the owners are based outside India and had not visited the land in a long time. Patel himself had suffered a paralytic attack, which resulted in 35-40% disability. His condition does not allow him to travel much and so he also was unaware of the situation with his land.

Patel only became aware of the issue in March, this year, and filed a petition against the developers as soon as he had all the necessary information. He also demanded that the builders did not sign the application they submitted to AUDA and so the permission to develop the land should be cancelled. The court has scheduled the next hearing for August 1.
